END USER LICENSE AGREEMENT (EULA)
Sdamix — Short-Term Rental Tracker
Effective date: June 27, 2026
BY DOWNLOADING, INSTALLING, OR USING THIS APPLICATION, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APPLICATION.
1. Parties and Apple’s role
This Agreement is between you and Kristel Maksimova («Developer»). Apple Inc. is not a party, is not responsible for the Application, and provides no warranties with respect to it. Apple is a third-party beneficiary and may enforce this Agreement against you.
2. License
Developer grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Sdamix on Apple devices you own or control, for personal non-commercial use, subject to this Agreement and the App Store Terms of Service.
3. Freemium model and future changes
The Application is currently free. The following changes are planned and disclosed in advance:
- Advertising: a future version may display ads in the free tier
- Paid subscription: removes advertising and unlocks additional features; core rental tracking remains free
- Feature limits: may be introduced in the free tier in future versions
- Cloud storage: optional; requires your explicit consent before any data leaves your device
- Third-party integrations (Booking, Airbnb, etc.): optional; data sharing will be disclosed and consent obtained
Any such changes will be reflected in an updated Agreement published before the relevant app version is released. Continued use after changes are posted constitutes acceptance.
4. Third-party data sharing and AI (Apple guideline 5.1.2(i), updated November 2025)
We will not share your personal data with third parties, including AI services, without your explicit consent. Any future integration that involves data sharing will: name the third party; specify what data is shared and for what purpose; require your affirmative consent before sharing begins; be disclosed in this Agreement and the Privacy Policy before the relevant update is released.
5. Subscriptions (when introduced)
Auto-renewing. Payment charged to Apple ID at confirmation. Cancel at least 24 hours before renewal: Settings → [Your Name] → Subscriptions → Sdamix. Cancellation does not delete your data. Refunds via Apple only: reportaproblem.apple.com
6. Ownership and restrictions
All rights in the Application belong to Developer. You may not: copy, modify, or distribute the Application; reverse engineer or extract source code; sell or transfer access; use for unlawful purposes; remove proprietary notices.
7. User data
Developer has no access to data you enter. Developer is not liable for its accuracy, completeness, or loss due to device failure, theft, or OS upgrades. You are solely responsible for backups.
8. DISCLAIMER OF WARRANTIES
THE APPLICATION IS PROVIDED «AS IS». TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRISTEL MAKSIMOVA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DEVELOPER DOES NOT WARRANT ERROR-FREE OPERATION OR THAT DATA ON YOUR DEVICE WILL NOT BE LOST.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRISTEL MAKSIMOVA IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, OR USD 10, WHICHEVER IS GREATER.
EU and Russian Federation consumers: nothing above limits your mandatory statutory consumer rights.
10. Governing law
This Agreement is governed by applicable law. EU consumers retain mandatory rights under their country of residence regardless of this clause.

ЗАГРУЖАЯ, УСТАНАВЛИВАЯ ИЛИ ИСПОЛЬЗУЯ ПРИЛОЖЕНИЕ, ВЫ СОГЛАШАЕТЕСЬ С УСЛОВИЯМИ.
1. Стороны и роль Apple
Соглашение заключается между вами и Kristel Maksimova («Разработчик»). Apple не является стороной Соглашения, но является третьим бенефициаром и вправе его применять.
2. Лицензия
Личная, неисключительная, непередаваемая, отзывная лицензия на использование Sdamix в личных некоммерческих целях.
3. Модель и планируемые изменения
Текущая версия бесплатна. Заранее раскрываем планируемые изменения:
- Реклама: будущая версия может отображать рекламу в бесплатном режиме
- Подписка: убирает рекламу, открывает допфункции; базовый учёт остаётся бесплатным
- Ограничения функций: могут появиться в бесплатном режиме
- Облачное хранение: опционально, требует вашего явного согласия
- Интеграции (Booking, Airbnb и др.): опционально, с раскрытием данных и вашим согласием
Любые изменения будут опубликованы до выхода соответствующей версии. Продолжение использования после обновления означает согласие.
4. Передача данных третьим сторонам и AI (требование Apple, ноябрь 2025)
Мы не передаём ваши персональные данные третьим сторонам, включая AI-сервисы, без вашего явного согласия. При любой будущей интеграции мы укажем: название третьей стороны; какие данные и зачем; получим ваше явное согласие до начала передачи.
5. Подписка (при введении)
Автопродление. Отмена за 24 часа до окончания периода: Настройки → [Ваше имя] → Подписки → Sdamix. Данные не удаляются. Возврат: reportaproblem.apple.com
6. Интеллектуальная собственность
Все права принадлежат Разработчику. Запрещается: копировать, модифицировать, декомпилировать, передавать доступ, использовать в незаконных целях.
7. Данные пользователя
Разработчик не имеет доступа к вводимым данным и не несёт ответственности за их точность или потерю. Резервное копирование — ответственность пользователя.
8. ОТКАЗ ОТ ГАРАНТИЙ
ПРИЛОЖЕНИЕ ПРЕДОСТАВЛЯЕТСЯ «КАК ЕСТЬ». В МАКСИМАЛЬНОЙ МЕРЕ, ДОПУСТИМОЙ ЗАКОНОМ, РАЗРАБОТЧИК ОТКАЗЫВАЕТСЯ ОТ ВСЕХ ГАРАНТИЙ, ВКЛЮЧАЯ ГАРАНТИИ ПРИГОДНОСТИ ДЛЯ КОНКРЕТНОЙ ЦЕЛИ, БЕЗОШИБОЧНОСТИ РАБОТЫ И СОХРАННОСТИ ДАННЫХ.
9. ОГРАНИЧЕНИЕ ОТВЕТСТВЕННОСТИ
В МАКСИМАЛЬНОЙ МЕРЕ, ДОПУСТИМОЙ ЗАКОНОМ, РАЗРАБОТЧИК НЕ НЕСЁТ ОТВЕТСТВЕННОСТИ ЗА КОСВЕННЫЕ, СЛУЧАЙНЫЕ ИЛИ ОСОБЫЕ УБЫТКИ, ВКЛЮЧАЯ ПОТЕРЮ ДАННЫХ ИЛИ ДОХОДА.
Совокупная ответственность: не превышает сумму за 12 месяцев до претензии или 100 рублей, если больше. Потребители из ЕС и РФ: настоящий раздел не ограничивает обязательных прав.
10. Применимое право
Регулируется применимым законодательством. Потребители из ЕС и РФ сохраняют обязательные права потребителей.
